Terms of Use

These Terms describe the rules for using Shorewise and explain the limits of the service as a boating awareness support product.
iOS End User License Agreement (EULA)
For iOS users, Shorewise uses Apple's standard End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
Additional Shorewise terms are listed below.

Shorewise is operated by AH Digital.

2. Acceptance of Terms
By accessing or using Shorewise, including the Shorewise website and mobile app, you agree to these Terms.
If you do not agree to these Terms, you should not use Shorewise.
3. What Shorewise Is
Shorewise is a boating awareness product designed to support awareness of shoreline proximity, speed-related alerts, route planning, map use, nearby boating points of interest, marine weather forecasts, and offline region pack access.
Shorewise is intended as a support tool and not as a substitute for seamanship, official instructions, maritime authorities, navigation instruments, local regulations, weather judgment, or safe operation of a vessel.
4. No Legal or Navigation Guarantee
Shorewise does not provide legal advice and does not guarantee compliance with any law, regulation, or maritime rule.
You remain solely responsible for navigation decisions, vessel handling, speed, lookout, weather assessment, route planning, compliance with official rules, and safety on the water.
Routes generated by Shorewise are advisory route suggestions only. They may be incomplete, approximate, or unsuitable for your vessel, conditions, draught, legal restrictions, hazards, or local requirements.
Alerts, maps, route suggestions, location estimates, downloaded pack data, weather forecasts, marine points of interest, and other outputs may be incomplete, delayed, unavailable, or inaccurate in some circumstances.
5. Eligibility and Use by Minors
Shorewise may be used by minors, but use of the app remains subject to these Terms.
If you allow a minor to use Shorewise, you are responsible for supervising that use and for their use of the service where applicable.
6. Acceptable Use
You agree not to misuse Shorewise, interfere with its operation, attempt to gain unauthorized access to related systems, reverse engineer protected components except where allowed by law, or use Shorewise in a way that could harm other users or the service.
You also agree not to rely on Shorewise as your only source of navigation or safety information.
7. Permissions and Device Requirements
Some Shorewise features depend on device permissions and hardware capabilities, including foreground or background location services, notifications, local storage, map functionality, connectivity, and audio or vibration playback.
If required permissions are denied or if your device does not support certain capabilities, some features may not function properly.
8. Offline Packs and Availability
Shorewise may allow you to download optional regional coastline data for offline use.
Offline content may change over time and may require updates, re-downloads, or removal. Availability of packs, regions, or features may change at any time.
9. Marine Weather and Third-Party Data
Weather, wind, wave, depth, seamark, coastline, fuel, marina, harbor, and mooring information may come from external providers or public datasets.
Forecast and map data is advisory only. Conditions can change quickly, model accuracy can be limited near coasts, bays, islands, marinas, and channels, and official sources and local judgment should always prevail.
Mooring or fuel information may be incomplete or outdated. Unknown fee status must not be treated as free, and availability should be verified locally.
10. Purchases and Billing
Shorewise may offer paid premium access through 1-month and 3-month auto-renewing subscriptions.
Subscriptions may be processed through the Apple App Store or Google Play, with entitlement management supported by RevenueCat. Billing, renewal, cancellation, refunds, and related platform purchase terms are handled by the relevant platform provider under that provider's rules.
Subscriptions renew automatically unless canceled before the end of the current billing period according to the rules of the app store where the subscription was purchased.
Refund requests are handled by the platform where the purchase was made. For purchases made through the Apple App Store or Google Play, please use that platform's refund process. Shorewise cannot directly issue refunds for purchases processed by Apple or Google.
Unless expressly stated otherwise, pricing, feature access, and product availability may change.
11. Intellectual Property
Shorewise and its branding, design, software, and related materials are protected by applicable intellectual property laws.
These Terms do not transfer ownership of Shorewise or its underlying materials to you. You receive only a limited right to use Shorewise as made available to you.
12. Third-Party Services
Shorewise may rely on third-party infrastructure or providers for maps, weather forecasts, public map datasets, downloads, app distribution, payments, hosting, or related functionality.
Those third-party services may have their own terms, policies, and operational limits, and Shorewise is not responsible for third-party services beyond Shorewise's own control.
13. Disclaimers
Shorewise is provided on an "as is" and "as available" basis to the extent permitted by applicable law.
To the extent permitted by law, Shorewise makes no warranty that the service will always be available, uninterrupted, error-free, accurate, complete, or fit for a particular purpose.
14. Limitation of Liability
To the extent permitted by applicable law, AH Digital will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, loss of profits, loss of business, or navigation-related outcomes arising from or related to use of Shorewise.
To the extent permitted by law, Shorewise's liability is limited because the service is an informational support tool and not a guaranteed navigation, legal, or safety system.
15. Suspension, Changes, and Termination
Shorewise may update, modify, suspend, or discontinue features, packs, pricing, design, or availability at any time.
Access to Shorewise may also be limited or stopped if necessary for maintenance, security, legal reasons, or service changes.
16. Privacy
Your use of Shorewise is also subject to the Shorewise Privacy Policy.
The Privacy Policy explains how Shorewise handles personal data and should be read together with these Terms.
17. Governing Framework
These Terms are intended to be interpreted in a manner consistent with applicable law, including relevant law in Croatia and, where applicable, European Union law.
If any provision of these Terms is found unenforceable, the remaining provisions should continue in effect to the extent permitted by law.
18. Changes to These Terms
Shorewise may update these Terms from time to time.
When these Terms change, the updated version will be posted with a revised effective date.
